A Tampa-area concrete recycling company ordered to stop operations was given a 60-day reprieve to vacate its Gibsonton, Florida, former headquarters, according to an article in the Tampa Bay Tribune.
According to the article Pro Way Construction Group was ordered to stop operations due to dust and noise. At a hearing on Oct. 21, Circuit Court Judge William P. Levens granted the company 60 additional days to cease operations at the facility. Levens issued an injunction against the company on July 6, giving it 90 days to vacate the premises.
According to the article, dump trucks continued to operate after the initial 90-day deadline of Oct. 8. The article says a disgruntled neighbor reported the continuing operations to Hillsborough County Code Enforcement in mid-October. This led the Hillsborough County Attorney’s Office to file a motion for contempt, which resulted in the Oct. 21 hearing.
According to the article, If Pro Way does not complete work at the site in 60 days, the county will fine the company $1,500 a day for up to 10 days. If the operations continue past that point the company will be called back to court to explain why to the judge, the article adds.
The article notes, Pro Way President Robert Vollmer told the newspaper the company was not able meet the original deadline because of unusually rainy weather in the summer.
