Recycling Facility Penalized For Solid Waste Violations

Duseau Trucking LLC, Hatfield, Mass., has agreed to process and remove from its facility all solid waste that it is not authorized to accept, as part of a recent consent order with the Massachusetts Department of Environmental Protection.

Duseau Trucking LLC will also pay $15,000 of a $25,000 penalty. The remaining $10,000 was suspended pending compliance with the terms of the order and completion of a study to evaluate the use of alternative fuels for the company's trucking fleet.

DEP discovered in 2002 that the company was improperly receiving, processing and transferring construction and demolition waste, concrete and wood waste without appropriate approvals and permits.

Under the terms of the consent order, Duseau Trucking has stopped accepting solid waste for which it is not permitted, is processing and removing all wood waste from the site, and will submit periodic status reports.

"The substantial penalty in this case demonstrates that DEP will act decisively when violations of the solid waste management regulations occur," said DEP Western Region Director Michael Gorski. "Duseau Trucking has acted in good faith to remedy these violations and we trust they will maintain full compliance with the rules."
