The Oregon Department of Environmental Quality (DEQ) has issued an $8,400 penalty to Dave Whitmore Excavating Inc., Newberg, Ore., for conducting asbestos removal work without a license during demolition of the Buckley’s Lockers building in August, 2011.
According to the DEQ, during the company’s demolition of the building, Aug. 2-4, the company mishandled and removed about 8,000 square feet of asbestos-containing roofing. The agency adds that Dave Whitmore Excavating is not licensed to perform asbestos abatement work in Oregon and was performing the work illegally.
During demolition of the building, Dave Whitmore Excavating mishandled the asbestos-containing roofing, likely releasing harmful asbestos fibers into the air.
In addition to the penalty, DEQ cited Dave Whitmore Excavating for openly accumulating asbestos-containing waste material. DEQ reported that the company allowed a portion of the material to sit unpackaged on the ground before it was properly disposed of by a licensed asbestos abatement contractor.
Dave Whitmore Excavating Inc. has appealed the penalty and will meet with DEQ officials to discuss the case further.
