The Ohio Environmental Protection Agency has reached a settlement with James Brothers Construction and Demolition Disposal to resolve violations at their facility in Muskingum County, Ohio. The settlement includes a $62,500 civil penalty.
James Brothers also agreed to stop disposing of construction and demolition debris in unauthorized areas of the site and to move that debris to an approved disposal area, with documentation to Ohio EPA; sample, manage, monitor and properly dispose of any leachate at the facility; and properly store scrap tires at the site and ensure adequate fire lanes. The facility has approval from Ohio EPA to use shredded scrap tires instead of gravel for the drainage layer in the required leachate collection system at the site.
Numerous inspections of the facility by Ohio EPA in 2002 and 2003 revealed on-going violations, which included: failure to have a leachate collection system; failure to conduct activities at the site in compliance with construction and demolition debris disposal regulations; failure to prevent water pollution; and failure to maintain scrap tire storage piles within the size limits required by Ohio regulations.
