Louisiana DEQ, Environmental Group Reach Agreement on C&D Landfill

DEQ settles suit filed over reopening of the Gentilly landfill in New Orleans.

The Louisiana Department of Environmental Quality (DEQ) has reached a settlement with the Louisiana Environmental Action Network (LEAN) on a lawsuit filed over the reopening of the Old Gentilly landfill in New Orleans, according to a report in New Orleans City Business.

LEAN filed the suit shortly after the landfill was reopened to accept construction and demolition debris in the wake of the hurricanes of 2005. The landfill was reopened shortly after Sept. 29, according to the report.

LEAN officials say they were concerned that the DEQ did not follow constitutionally mandated procedure and look for other alternatives to dumping at the Old Gentilly site, according to the report.

The settlement limits disposal of debris at the landfill to 19,000 cubic yards per day until the DEQ assesses using other sites and disposal methods. The DEQ will also monitor the ground and surface water at the site, and there will be a 60-day public comment period, according to the report.
