CIWMB Calls for Public Comment

California agency seeks input from the public as it looks to develop a C&D ordinance.

The California Integrated Waste Management Board has put out for public comment a model construction and demolition ordinance that the state’s communities can adopt to require Construction & Demolition recycling in their jurisdictions.

The IWMB was directed to develop the ordinance by the state legislature. The bill directing the action did not require jurisdictions to adopt a C&D ordinance, nor require them to adopt the board’s model ordinance as their own by default. According to the website hosting the model ordinance (http://www.ciwmb.ca.gov/LGLibrary/LocalDocs/CandDModel/) the board was required to “adopt one or more model ordinances, suitable for modification by a local agency, that the local agency may adopt that will require a range of diversion rates of C&D waste materials from 50 to 75 percent, as determined by the board, and as measured by weight.”

The model ordinance was developed by suggestions from local government, building industry representatives, C&D recyclers, and waste management companies. Also, the most typically used sections in already used municipal ordinances in the state were included.

Anyone interested in commenting on the proposed ordinance is urged to go to the above website to see the total draft model ordinance. The Construction Materials Recycling Association, through its Southern California chapter, plans on providing comments, according to Kelly Ingalls, Regional Director.

In addition to the model ordinance, the board staff is developing a local government C&D information web page that will contain information about methods for diverting C&D waste. The information page will be available for public comment in the near future.
