Ken Pierman and Ken Pierman Contracting Inc. have been fined a total of $15,000, plus a 25-percent victim fine surcharge, after being found guilty of illegally depositing demolition waste. The fines were levied by the Ontario (Canada) Ministry of the Environment.
The Court heard that Ken Pierman Contracting Inc. carries out a variety of contract jobs, one of which is hauling and disposing of demolition wastes. Ministry of the Environment inspections conducted on October 18, 19 and 31, 2001 revealed that the company was depositing demolition wastes on a property that was not an MOE approved waste disposal site.
Ken Pierman was fined $5,000 and Ken Pierman Contracting Inc. was fined $10,000 on one charge each under section 40 of the Environmental Protection Act for depositing waste on a non-approved site. Both defendants have prior environmental convictions.
The case was heard Oct. 23-24 by the Ontario Court of Justice in Sault Ste. Marie.
